Introduction

Welcome to Direct Cars. These Terms and Conditions ("Terms") govern your purchase of vehicles and use of our services. By purchasing a vehicle or interacting with Direct Cars, you agree to be bound by these Terms.

1.1. Statutory Warranty

Under Queensland law, certain used vehicles sold by licensed motor dealers come with a statutory warranty. This warranty applies if the vehicle:

• Has an odometer reading of less than 160,000 km on the day of sale; and
• Was manufactured less than 10 years before the day of sale.

For such vehicles, the statutory warranty expires after three months or the first 5,000 km, whichever occurs first. 

If the vehicle has an odometer reading of 160,000 km or more, or was manufactured 10 years or more before the day of sale, a 'Class B' statutory warranty applies, expiring after one month or the first 1,000 km, whichever occurs first. 

1.2. Consumer Guarantees

Regardless of the statutory warranty, all vehicle sales are subject to consumer guarantees under the Australian Consumer Law. These guarantees ensure that vehicles are of acceptable quality, fit for purpose, and match their description. These rights cannot be excluded, even if the vehicle is sold "as-is." 

1.3. Inspection Responsibility

Customers are encouraged to thoroughly inspect vehicles before purchase. Test drives, mechanical inspections, and review of vehicle history are available upon request.

2.1. Payment Requirements

Payment in full is required at the time of purchase unless a specific financing arrangement has been agreed upon.

2.2. Accepted Payment Methods

Accepted payment methods include bank transfer, credit card, or cash. A receipt will be issued upon payment completion.

2.3. Ownership Transfer

All vehicles remain the property of Direct Cars until payment has been received in full.

3.1. No Refunds or Returns

All vehicle sales are final. Refunds, returns, or exchanges will not be offered after the transaction is completed, except as required by law.

3.2. Deposits

Any deposits made to reserve a vehicle are non-refundable unless otherwise agreed upon in writing.

4.1. Registration Responsibility

The buyer is responsible for transferring ownership and registering the vehicle in their name with the relevant authorities.

4.2. Compliance Assurance

Direct Cars ensures all vehicles are legally compliant with Gold Coast and Australian regulations at the time of sale.

5.1. Data Collection

Direct Cars collects personal information (e.g., name, contact details, and payment information) as part of the transaction process.

5.2. Data Security

All personal data is stored securely and is accessible only by authorized employees for business purposes, such as completing sales, after-sales support, and regulatory compliance.

5.3. Data Sharing

Direct Cars will not share your personal data with third parties without your consent, except as required by law.

5.4. Data Access and Deletion

You have the right to request access to your personal data or request its deletion by contacting us directly.

6.1. Post-Sale Liability

Direct Cars is not responsible for any loss, damage, or liability arising from the use or ownership of the vehicle after the sale, except as required by law.

6.2. Information Accuracy

Direct Cars disclaims liability for any misrepresentation or errors in the information provided about vehicles, except where such errors are intentional or grossly negligent.

7.1. Amicable Resolution

In the event of a dispute, Direct Cars aims to resolve the matter amicably. Should a resolution not be possible, the matter may be referred to an independent mediator or pursued through the Australian legal system.

8.1. Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia.

8.2. Legal Proceedings

Any legal proceedings must be brought in a court of competent jurisdiction within Queensland.

9.1. Right to Amend

Direct Cars reserves the right to update or amend these Terms without prior notice. Any changes will be effective immediately upon posting to our website or other written communication.

By purchasing a vehicle from Direct Cars, you acknowledge that you have read, understood, and agreed to these Terms. If you have any questions or require clarification, please contact us prior to completing your purchase.
